These Terms of Service ("Terms") govern your access to and use of Email Marketing Pro ("we," "us," or "our"), an email marketing platform. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
To use our services, you must create an account by providing accurate and complete information. You may register using your email address and password, or through Google OAuth. You are responsible for:

You agree to use Email Marketing Pro only for lawful purposes and in compliance with all applicable laws, including but not limited to CAN-SPAM, GDPR, CASL, and other anti-spam and data protection regulations. You must not:
We reserve the right to suspend or terminate accounts that violate this policy, with or without prior notice. High bounce rates or complaint rates may also result in account suspension to protect our sending infrastructure.
You retain full ownership of the contact data you upload to our platform. You are the data controller and are solely responsible for:
We act as a data processor on your behalf and will process contact data only as necessary to provide our services.
You may configure custom domains for sending emails. You must own or have authorization to use any domain you register on our platform. You are responsible for configuring the required DNS records for domain verification. We reserve the right to remove domains that fail verification or are associated with abusive sending behavior.
You may purchase email credits in advance. Each credit entitles you to send one email. Credits do not expire and remain in your account until used. Credit purchases are non-refundable except where required by applicable law.
Under the pay-as-you-go model, you are billed monthly based on the number of emails sent during the billing period. Invoices are processed through Paddle, our payment provider.
All payments are processed by Paddle, which acts as our Merchant of Record. Paddle handles billing, invoicing, sales tax, and refunds. By making a purchase, you also agree to Paddle's terms of service. We do not store your payment card details.
Credits are deducted at the time each email is sent. You must have sufficient credits to send a campaign. If your credit balance is insufficient, the campaign will not be processed. Failed deliveries (bounces) still consume credits, as the sending attempt was made.
Our platform automatically inserts a tracking pixel and rewrites links in your emails to provide open and click tracking. This data is collected to generate campaign analytics and reports. You are responsible for disclosing the use of email tracking to your recipients where required by applicable law. Analytics data is available for the lifetime of your account and is deleted upon account termination.
We automatically include a one-click unsubscribe link in every campaign email sent through our platform. When a recipient unsubscribes:
You must not attempt to re-subscribe contacts who have opted out or send emails to contacts marked as bounced or complained.
The Email Marketing Pro platform, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You retain ownership of the content you create and upload, including email templates, images, and contact data.
You grant us a limited license to use your content solely for the purpose of providing our services (such as rendering templates and delivering emails). This license terminates when you delete the content or close your account.
We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend the platform for maintenance, updates, or circumstances beyond our control. Email delivery is provided via Amazon SES, and delivery times and rates depend on factors including recipient mail servers, content quality, and sender reputation. We do not guarantee specific delivery rates or inbox placement.
To the maximum extent permitted by law, Email Marketing Pro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of data, or business interruption arising from your use of our services.
Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, particularly the Acceptable Use policy. Upon termination:
You agree to indemnify and hold harmless Email Marketing Pro and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, the content of your emails, or your violation of any applicable laws or third-party rights.
We may modify these Terms at any time. When we make material changes, we will notify you by email or through a notice on our platform at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the service and close your account.
